Welcome

Spotlight Yoyo (spotlightyoyo.com, the "Site") is owned and operated by Hunter Yoyos LLC ("Hunter Yoyos," "we," "us," or "our"). The Site includes our online store, coaching and team information, videos, tutorials, and any other content or services we offer through the Site (together, the "Services").

By visiting the Site, creating an account, joining a program, or placing an order, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

We update these Terms from time to time. The date at the top tells you when the current version took effect. Continued use of the Site after a change means you accept the updated Terms.

Our store is hosted on Shopify, which provides the ecommerce platform behind our checkout.

1. Who Can Use the Site

Anyone can browse the Site. To place an order, sign up for a program, or create an account, you must be at least 18 years old, or use the Site with the permission and supervision of a parent or legal guardian.

Many of our customers and students are under 18. If you are a parent or guardian placing an order or enrolling a child, you accept these Terms on that child's behalf and take responsibility for their use of the Site.

You agree not to use the Site for anything illegal, to break any law in your area, to interfere with how the Site works, or to introduce viruses, bots, scrapers, or other harmful code. If you do, we can end your access right away.

2. Orders and Products

Placing an order is an offer to buy. We accept the order when we ship the product or confirm the program enrollment. We reserve the right to decline or cancel any order for any reason, including suspected fraud, pricing errors, stock issues, or orders that appear to come from resellers.

We do our best to show products accurately. Colors can look different across screens, and yo-yo finishes, splash patterns, and engravings vary slightly from piece to piece. Small differences from photos are normal and are not defects.

Stock is limited on many items. We may limit quantities per customer, per order, or per household, and we may discontinue any product at any time without notice.

Prices are in U.S. dollars and can change without notice. If we list a product at an obviously wrong price, we may cancel the order and refund you in full before shipping.

You are responsible for giving us accurate shipping, billing, and contact information and for keeping it current. We are not responsible for delays or lost packages caused by an incorrect address you provided.

3. Shipping, Returns, and Refunds

Shipping times shown at checkout are estimates. Once a package leaves our hands, carrier delays are outside our control, though we will help you track it down.

Returns, exchanges, and refunds follow our Refund Policy, posted separately on the Site. Read it before you buy. Custom, personalized, or engraved items are generally final sale unless they arrive damaged or defective.

4. Coaching, Lessons, and Team Programs

If you register for coaching, lessons, clinics, camps, or Spotlight Team programs, the following applies in addition to everything else in these Terms.

Yo-yo play is a physical activity. Participants can be hit by a yo-yo, tangle a string, or lose balance. By enrolling yourself or your child, you accept these ordinary risks and agree that Hunter Yoyos, its coaches, and volunteers are not responsible for injuries that come from normal participation, except where caused by our gross negligence or willful misconduct.

Program fees, schedules, refund windows, and cancellation rules are stated at registration. Missed sessions are not refundable unless the program description says otherwise. We may cancel or reschedule a session for weather, illness, venue issues, or low enrollment, and we will offer a makeup session or credit when we do.

Parents and guardians must provide accurate emergency contact and health information relevant to participation. Coaches are not medical providers.

5. Photos and Video at Events

We often photograph and record lessons, competitions, and team events for our website, social media, and promotional materials. By participating, you consent to appearing in this content without compensation. If you or your child do not want to be included, tell us in writing before the event and we will make reasonable efforts to keep you out of published content.

6. Your Account

If you create an account, keep your password private. You are responsible for everything done through your account. Tell us right away if you think someone else has accessed it.

7. Content You Send Us

Reviews, comments, trick submissions, photos, videos, suggestions, and any other material you send us or post on the Site are "Submissions."

By sending a Submission, you give Hunter Yoyos a worldwide, royalty-free, perpetual license to use, edit, reproduce, publish, and share it in any medium, including in marketing. You keep ownership of your Submission. We have no obligation to keep it confidential, credit you, or pay you for it.

You promise that your Submissions are yours to share, do not infringe anyone else's rights, and do not contain anything unlawful, abusive, obscene, or misleading. We may remove any Submission at our discretion.

8. Our Content and Trademarks

Everything on the Site that we created, including the Spotlight Yoyo and Hunter Yoyos names and logos, product designs, photos, videos, tutorials, text, and graphics, belongs to Hunter Yoyos LLC or our licensors. You may view and share links to our content for personal, noncommercial purposes. You may not copy, sell, redistribute, or build a competing product or service from it without our written permission.

Other brand names appearing on the Site belong to their respective owners.

9. Third-Party Links and Tools

The Site may link to other websites, social platforms, payment processors, and tools we do not control. We are not responsible for their content, policies, or how they handle your information. Review their terms before you use them. Any third-party tool we make available is offered as-is, without warranty.

10. Site Accuracy

We work to keep the Site accurate, but errors happen. Product descriptions, prices, availability, and other details may be wrong or out of date. We may correct errors and update or remove content at any time, including after you have placed an order, and we have no duty to update older information.

11. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Site, you agree to that policy.

12. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or to encourage others to do so
• Infringe anyone's intellectual property or privacy rights
• Harass, threaten, or discriminate against anyone
• Submit false or misleading information, including fake orders or reviews
• Upload malware or attempt to bypass Site security
• Scrape, mirror, or bulk-download Site content
• Interfere with other users' ability to use the Site

We can suspend or terminate access for any violation.

13. Disclaimer of Warranties

The Site and Services are provided "as is" and "as available." We do not promise the Site will be error-free, secure, or available at all times. Except as required by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Products we sell are covered only by the warranties described on the product page or in our Refund Policy.

14. Limitation of Liability

To the fullest extent the law allows, Hunter Yoyos LLC, its owners, coaches, employees, and contractors are not liable for indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of the Site, our products, or our programs.

Our total liability to you for any claim will not exceed the amount you paid us for the product or program involved in the claim, or $100 if you paid nothing.

Some states do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to defend and hold harmless Hunter Yoyos LLC and its owners, coaches, employees, contractors, and affiliates from any claim, loss, or expense (including reasonable attorney fees) that arises from your breach of these Terms, your Submissions, or your violation of any law or third-party right.

16. Termination

You can stop using the Site at any time. We can suspend or end your access at any time, with or without notice, if you violate these Terms or if we discontinue the Site. Sections that by their nature should survive (including payment obligations, licenses to Submissions, disclaimers, limitation of liability, and indemnification) remain in effect after termination.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute you cannot resolve with us informally will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to that venue.

Before filing anything, contact us. Most issues get resolved with an email.

18. General

If any part of these Terms is found unenforceable, the rest still applies. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Refund Policy and Privacy Policy, are the entire agreement between you and Hunter Yoyos LLC regarding the Site. Any ambiguity will not be read against either party because one of us drafted the language.
